The phrase does not occur in the jurists of the Pandects, the institution of the vadimonium being abolished by Marcus Aurelius. It is found in the following three places only: quid si vadimonium capite obvoluto stitisses? Cat. ap. Gell. 2, 14, 1: ut Quinctium sisti Alfenus promitteret. Venit Romam Quinctius;
